Terms of Use

Welcome to Stadium Swag. These Terms of Use ("Terms") govern your use of the Stadium Swag marketplace, where fans can buy, sell, and trade exclusive sports giveaway collectibles. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. The Marketplace

Stadium Swag is a platform that connects buyers and sellers. We provide the listing, discovery, checkout, and payout tools, but we are not a party to any transaction between users. Listings and transactions are conducted between users at their own risk.

2. Your Account

• You must provide accurate information when registering and keep it up to date.
• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must be at least 13 years old to use the app, and of legal age to enter binding contracts in your jurisdiction.

3. Seller Responsibilities

• Accurate listings — describe items truthfully, including condition, event details, and photos that represent the actual item.
• Shipping and handling — ship items within the handling time you specify and charge only the flat-rate shipping you disclosed.
• Stripe Connect — to receive payouts, you must complete Stripe Connect onboarding. Payouts are made to your connected Stripe account.
• Prohibited items — do not list counterfeit, stolen, or illegal items, or items you do not have the right to sell.

4. Buyer Responsibilities

• Review listings carefully before purchasing. Transactions are between you and the seller.
• Provide accurate shipping information at checkout so the seller can fulfill your order.
• Use the review system honestly and only for orders you have completed.

5. Platform Fee and Payouts

• Stadium Swag charges an 8% platform fee on each completed sale, deducted from the item price.
• The seller receives the item price minus the platform fee, plus the shipping charge, transferred to their Stripe Connect account.
• Shipping charges are included in the buyer's checkout total for shipped orders and are excluded for local pickup.
• Seller perks may unlock after six months of selling tenure and at least one completed paid sale, as determined by the platform.

6. Prohibited Conduct

• Do not harass, deceive, or defraud other users.
• Do not manipulate reviews, ratings, or perks eligibility.
• Do not attempt to circumvent checkout or payment systems, or to transact off-platform to avoid fees.
• Do not scrape, overload, or disrupt the app or its services.

7. Transactions at Your Own Risk

Stadium Swag facilitates listings and payments but does not guarantee the accuracy of listings, the performance of sellers or buyers, or the outcome of any transaction. To the fullest extent permitted by law, you use the marketplace at your own risk.

8. Intellectual Property

The Stadium Swag name, logo, and app design are owned by Stadium Swag. You retain ownership of the photos and content you submit for your listings, and grant us a license to display them within the marketplace. Do not upload content that infringes the rights of others.

9. Limitation of Liability

To the fullest extent permitted by law, Stadium Swag is not liable for indirect, incidental, or consequential damages arising from your use of the app, or for the actions or inactions of other users. Our liability is limited to the extent permitted by applicable law.

10. Dispute Resolution

We encourage users to resolve disputes directly. If a dispute cannot be resolved, it will be handled in accordance with the laws of the jurisdiction where Stadium Swag operates, unless otherwise required by local law.

11. Account Deletion

You can delete your account at any time from the Account page. Deleting your account removes your profile and personal data, though some records may be retained as required by law.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective" date above. Continued use after changes take effect means you accept the updated Terms.
